product quality/specification
the quality of the product to be supplied under this agreement shall be standard nnpc export specification: bonny light crude oil.

all parties agree to a tolerance level of plus or minus 5%-10%, with respect to the quality inspection, unless otherwise stipulated.
an independent inspection company such as sgs, saybolt or robinson’s shall conduct the verification as to quantity and quality. buyer may nominate another recognized inspection agent to act on their behalf.
general procedure
(please keep in mind that this is a general procedure draft from the seller. it can be adjusted according to the buyer needs.)
1. the buyer send loi to the seller. seller issues spa to buyer . buyer signs and returns with port of discharge agent details and atb/nor/eta formats.
2a. buyer’s bank using bank letter headed paper writes to seller’s bank indicating interest to issue sblc ( dlc may be considered ) to seller through sellers bank and request the need for a 2% pb from the sellers bank to activate the dlc. seller’s bank using bank letter headed paper writes back to buyer’s bank to indicate ability to issue 2% pb as soon as the buyer’s sblc ( dlc may be considered ) is received and confirmed from a prime bank.
2b. buyer’s prime bank issue non operative sblc ( dlc may be considred ) via mt700/mt542/mt760 for $100m valid for 90 days to guarantee buyer’s performance with seller’s verbiage .
3. seller’s bank validates the non operative sblc ( dlc may be considered ) and if successful and genuine, issues 2% performance bond to buyer’s bank to activate the dlc to guarantee seller's performance.
4. seller loads or assign an exclusive vessel in buyer’s name; issues full set of vessel and cargo documents to the buyer in the name of buyer as the consignee of record and authorizes vessel captain to move vessel to buyer’s port of discharge with periodic nor/eta to the buyer and buyer’s discharge harbor/tank agent.
5. at the buyer’s discharge port, buyer clears the vessel while the captain issues authority to board (atb) to enable buyer’s independent inspectors to perform q/q at mutually agreed location.
6. upon successful conclusion of q/q analysis, inspectors release report to both parties while seller issue commercial invoice to the buyer with exact q/q report figures.
7. buyer releases full payment for cargo to seller's nominated bank within 48 hours after inspection against q/q report, commercial invoice and cargo documents by mt-103 (cash wire).
8. seller confirms payment & authorize captain to discharge cargo into buyer’s storage tank.
9. seller and buyer pay commissions to all agents and facilitators involved in the transaction.
